小卖家之间利用版权DMCA恶意投诉竞争对手的事也不少
那到底什么是DMCA？
DMCA即数字千年版权法案，英文全称“Digital Millennium Copyright Act”，简称DMCA。权利人可以要求线上服务提供商在网站内容方面接到版权所有者或其代理人涉嫌侵权的通知(即“DMCA通知”)后，迅速删除不当内容，即可免除版权侵权责任。
这一条列现在也是被还多卖家滥用来投诉竞争对方。
收到这类版权投诉应该怎么办？
1)先与投诉方联系，要求对方提供版权所有权证明或授权证明，如果对方确实是版权所有者或获取了授权，可以协商解决方案;
2)如果对方不提供版权所有权证明或授权证明，又不肯撤销侵权投诉，我们可以根据DMCA反通知流程向亚马逊申诉。
根据 DMCA 提交反通知的流程
如果您的某件商品由于版权所有者根据数字千年版权法 (DMCA) 提出侵权投资而被移除，但您认为投诉中涉及的内容并未侵权，您可以向提交反通知。
要提交反通知，请执行以下操作：
转至【账户状况】>【政策合规性】>【收到的知识产权投诉】。
找到您想要申诉的商品的停售记录，然后点击该记录旁边的【申诉】。注意：如果您要提交其他信息，请单击停售记录旁边的【查看申诉】。单击【提交其他信息】，提交重新启售商品所需的信息。
反通知必须包括以下信息：
被移除或禁用的材料，以及移除或禁用之前材料所在的位置

第二段：如果投诉者不提供版权或授权证明，可参考A段；如果投诉者并不是版权的所有者或授权人，滥用版权投诉，可以参考B段。
A段：The complainant has provided no copyright registration information or other tangible evidence that the material in question is in fact copyrighted, and I have a good faith belief that it is not. The allegation of copyright violation is therefore in dispute, and at present unsupported.(投诉人没有提供任何版权登记信息或授权书证明被下架内容有版权)

第三段：写投诉人没有按照DMCA规定的形式要求进行投诉：
